AltaVista Holiday Lighting – Service Agreement
This Standard Service Agreement (“Agreement”) governs holiday-lighting services provided by Alta Vista Holiday Lighting LLC, doing business as Alta Vista Holiday Lighting (“Alta Vista,” “we,” “us,” or “our”).
Each customer’s approved proposal identifies the customer, service address, scope of work, materials, pricing, deposit, and estimated service schedule. By signing or electronically accepting a proposal that references this Agreement, the customer (“Customer”) agrees to these terms.
1. Scope of Services
1.1. Alta Vista will provide the products and services described in the Customer’s approved proposal, which may include design, installation, seasonal maintenance, takedown, labeling, packaging, and storage.
1.2. Services or materials not included in the approved proposal are not included in the project price.
1.3. Changes to the approved design, materials, quantities, or scope of work may result in additional charges or scheduling changes.
1.4. Any substantial change must be approved by the Customer and Alta Vista in writing before the additional or modified work is performed.
2. Deposit and Payment Terms
2.1. A 50% deposit is required to approve the project, reserve installation availability, and purchase or allocate project-specific materials.
2.2. The remaining 50% balance is due immediately upon completion of the installation, unless otherwise agreed in writing.
2.3. Additional work or approved changes will be invoiced separately.
2.4. Invoices are due upon receipt. Alta Vista may postpone maintenance, takedown, storage, or other services while an account is past due.
2.5. The Customer agrees to pay reasonable collection costs resulting from nonpayment where permitted.
3. Ownership of Materials
3.1. Unless otherwise stated in the approved proposal, lighting and décor purchased as part of the project become the Customer’s property after full payment.
3.2. When included in the approved proposal, Alta Vista will remove, label, package, and store the Customer’s lighting system after the display season.
3.3. Future-season installation, maintenance, takedown, and storage are separate seasonal services and will be priced or confirmed before each season.
3.4. The Customer may not alter, relocate, remove, repair, or permit another party to service the installed system during the display season without first notifying Alta Vista.
3.5. Alta Vista is not responsible for the condition, compatibility, performance, or lifespan of Customer-supplied lighting or décor. Additional charges may apply when Customer-supplied products require unexpected preparation, repair, or replacement.
4. Installation and Takedown
4.1. Alta Vista will perform the installation in a safe, professional, and workmanlike manner.
4.2. Takedown is included when stated in the approved proposal and will generally occur during Alta Vista’s seasonal removal period unless otherwise arranged.
4.3. Installation and takedown dates may be provided as estimated service windows rather than guaranteed dates.
4.4. The Customer grants Alta Vista reasonable access to the property for installation, maintenance, inspection, takedown, and other agreed services.
4.5. Alta Vista may stop or decline work if unsafe conditions, unsuitable surfaces, inadequate electrical service, undisclosed hazards, or work outside the approved scope are discovered.
5. Maintenance and Service
5.1. Reasonable seasonal maintenance is included for lighting and décor supplied and installed by Alta Vista during the applicable display season.
5.2. Included maintenance may cover:
Failed bulbs or components
Loose clips or displaced strands
Timer adjustments
Connection issues resulting from Alta Vista’s installation
5.3. The Customer must notify Alta Vista promptly after discovering an issue.
5.4. Complimentary maintenance does not cover repairs resulting from:
Customer or third-party tampering or alterations
Customer-supplied products
Pets, animals, pests, landscapers, contractors, vehicles, or equipment
Vandalism or theft
Defective outlets, inadequate electrical service, or unrelated power issues
Severe weather or circumstances outside Alta Vista’s reasonable control
5.5. Repairs excluded from complimentary maintenance may result in additional charges after notice to the Customer.
6. Customer Responsibilities
The Customer agrees to:
6.1. Provide accurate information concerning the property and requested work.
6.2. Provide safe and clear access to all necessary installation and removal areas.
6.3. Provide accessible, functional, and suitable outdoor electrical outlets.
6.4. Ensure the property has sufficient electrical capacity for the approved display.
6.5. Notify Alta Vista of loose shingles, damaged gutters, electrical issues, underground systems, pets, security systems, landscaping concerns, or other known hazards.
6.6. Keep landscaping reasonably accessible for installation and removal.
6.7. Obtain any required approval from the property owner, landlord, condominium association, homeowners association, or other responsible party.
6.8. Keep people, pets, vehicles, and personal property away from active work areas.
6.9. Avoid connecting additional equipment to or modifying the installed system without Alta Vista’s approval.
7. Scheduling, Weather, and Delays
7.1. Installation scheduling is based on proposal acceptance, deposit receipt, project requirements, location, seasonal availability, and weather.
7.2. Rain, snow, ice, wind, unsafe roof conditions, product delays, or other circumstances may require installation, maintenance, or takedown to be rescheduled.
7.3. Alta Vista is not responsible for delays caused by weather, unsafe conditions, utility interruptions, product shortages, inaccessible property, or circumstances outside its reasonable control.
7.4. Alta Vista will make reasonable efforts to notify the Customer of material delays and reschedule the work as soon as safely practical.
8. Property Conditions and Liability
8.1. Alta Vista carries general liability insurance and takes reasonable precautions while performing its services.
8.2. Alta Vista is not responsible for pre-existing, concealed, deteriorated, or undisclosed conditions, including:
Loose or damaged shingles
Weak or damaged gutters
Deteriorated trim, siding, or masonry
Fragile landscaping
Defective outlets or electrical systems
Structural issues
Improper prior repairs
8.3. Alta Vista is not responsible for damage, outages, or service interruptions caused by severe weather, animals, pests, vandalism, utility failure, Customer actions, or third parties.
8.4. The Customer is responsible for damage or additional service requirements caused by property conditions or actions outside Alta Vista’s reasonable control.
9. Electrical Conditions
9.1. The Customer is responsible for providing functional electrical outlets and sufficient electrical capacity.
9.2. Alta Vista does not perform permanent electrical modifications as part of its holiday-lighting services.
9.3. Electrical defects or work outside the approved scope may require the Customer to hire a properly qualified electrician before installation or operation can continue.
10. Takedown and Storage
10.1. When included in the approved proposal, Alta Vista will remove, label, package, and store the lighting system after the display season.
10.2. The Customer must provide reasonable property access during the scheduled takedown period.
10.3. Additional charges may apply when frozen materials, inaccessible areas, property changes, landscaping, construction, or third-party alterations substantially increase the removal work.
10.4. Ordinary wear, manufacturer defects, age-related failure, and gradual deterioration are not considered damage caused by Alta Vista.
11. Cancellation and Rescheduling
11.1. Cancellation and rescheduling requests must be submitted in writing.
11.2. If Alta Vista cancels the project before installation and cannot reasonably reschedule it, amounts paid for unperformed services will be refunded.
11.3. If the Customer cancels after project-specific materials have been ordered, cut, prepared, or allocated, Alta Vista may retain the portion of the deposit reasonably attributable to those materials, preparation, and other committed project costs.
11.4. Customer-requested rescheduling is subject to seasonal availability and may result in a later installation window.
11.5. Any cancellation rights required by applicable law remain unaffected.
12. Photographs and Marketing
12.1. Alta Vista may photograph completed exterior displays for documentation, quality control, portfolio, website, social-media, and advertising purposes unless the Customer opts out in writing before installation.
12.2. Alta Vista will not intentionally publish Customer names, exact residential addresses, vehicle license plates, home interiors, or other identifying personal information without permission.
13. Terms of Service and Privacy Policy
13.1. The Customer acknowledges that Alta Vista’s Terms of Service and Privacy Policy also apply to the project and are available at https://altavistalighting.com.
13.2. If this Agreement conflicts with the general Terms of Service, this Agreement and the Customer’s approved proposal will control.
14. Entire Agreement
14.1. The Customer’s approved proposal, this Agreement, the Terms of Service, and any written changes constitute the complete agreement between the Customer and Alta Vista regarding the project.
14.2. No verbal statement or modification changes the Agreement unless confirmed in writing by the Customer and Alta Vista.
15. Acceptance
The Customer accepts this Agreement by signing or electronically approving a proposal that references it. No separate signature is required on this website page.
